Artur's intro in plain english:

Privacy is a serious deal for me. I care about my own privacy. This is one of the reasons why WithSubtitles tools were created - I wanted to add subtitles to videos without fear that someone unwanted might have access to my videos.

  • I try to do as much as possible directly on your device and not send anything that is not needed to my (or any other) servers.
  • Your video NEVER leaves your device. No one can access it.
  • I only send audio extracted from video to transcribe services to get transcription text back.
  • I collect minimal data necessary to verify subscriptions and prevent fraud: pseudonymous identifiers, transaction information, and credits usage. No data is used for tracking or profiling.
  • All accounts are anonymous from my perspective — I cannot identify who you are. However, some data I collect (like randomly generated device or customer IDs) may still be considered "personal data" under privacy laws, even though I cannot use it to determine your real identity.
  • I collect minimal technical logs: server logs for API requests (transcriptions, subscription verification, etc.) and error reports from the app. These logs help me troubleshoot issues and ensure the service runs reliably. Without this, it would be difficult to diagnose any errors and be able to react.

Below you will find the actual privacy policy written in a slightly more formal manner.

This Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your information when you use the WithSubtitles application ("Service"), and informs you about your privacy rights and how the law protects you.

We use your personal data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Definitions

For the purposes of this Privacy Policy:

  • Account – means an anonymous identity created automatically for a user. You do not create a user account with login credentials; instead, an anonymous device and customer identifiers are generated to manage your free tier and a subscription.
  • Application (the "Service") – refers to WithSubtitles, the software program provided by the Company.
  • Company (referred to as "the Company", "We", "Us" or "Our" in this Agreement) – refers to Artur Rosa, located at Antoniego Słonimskiego 16/7a, 50-304 Wrocław, Poland.
  • Device – means any device that can access the Service, such as a smartphone or tablet.
  • Personal Data – means any information that relates to an identified or identifiable individual.
  • Service – refers to the Application (WithSubtitles) and any related services provided through the Application.
  • Service Provider – means any natural or legal person who processes data on behalf of the Company. This includes third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on our behalf, to perform services related to the Service, or to assist us in analyzing how the Service is used.
  • Usage Data – refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, information about how long a page was visited).
  • You – means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Information We Collect and How We Use It

Types of Data Collected

Personal Data

While using our Service, we may collect certain information. Personal Data we collect may include:

  • Contact Information: Email is collected when you voluntarily enter it and submit the in-app support or report form. When you contact us through this form, we collect your email address (so we can respond) and any other information you include in your message. We may also collect your name or other contact details if you provide them in your support inquiry.
  • Payment Information: Subscriptions are purchased exclusively through Apple App Store In-App Purchases (IAP). When you make a purchase through the App Store, Apple processes your payment according to their privacy policy and terms. We do not receive your payment card details, billing address, name, or email from Apple. We use RevenueCat (a subscription management service) to verify purchases and manage subscription status. RevenueCat processes: (1) End User Technical Information: device type and operating system, (2) End User Transaction Information: last seen time and Apple receipt data. No personal identifiers like your name or email are collected by us from purchases. For more information, please refer to Apple's privacy policy and RevenueCat's privacy policy.
  • User Communications: If you use the support or report form within the app, you will need to provide an email address (so we can reply) and a message describing your issue or feedback. This is a voluntary submission by you. We collect the information you choose to provide in that message, which may include additional contact information or details about your request. We use this data solely to provide support and respond to you. Email is not collected for any other purpose.
  • User Content (Audio/Video): A core feature of WithSubtitles is generating text subtitles from your video or audio content. When you use this feature, you may upload a video or audio file. We do not permanently store the videos or audio files you provide on our servers. The process works as follows: the application (on your device) extracts the audio track from your video and sends that audio data to our server temporarily for transcription. The audio may be processed by our servers and relayed to our transcription Service Providers (explained below) to convert speech to text. We do not associate this audio data with your identity other than a technical session ID needed for processing. Once the transcription process is completed and the text subtitles are delivered back to you, we do not keep the audio file or the transcription on our servers. Any audio or transcript data is handled in-memory or in temporary storage strictly for the purpose of providing you the Service, and is discarded shortly thereafter. It's stored permanently only on your device. (Please note: The audio content you provide could include voices or information that might be considered personal data. While we do not use it to identify you, it is processed by third-party transcription services as described below.)

Usage Data

We collect minimal usage data, and only in specific circumstances:

  • Server Logs: When you use features that require server communication (such as transcription requests or subscription management and verification), our servers automatically log API requests for operational and troubleshooting purposes. These logs may include timestamps, device and customer identifiers, request types (e.g., transcription request, subscription verification), and response codes. We use these logs to monitor server health, troubleshoot technical issues, identify potential security threats, and ensure the Service is functioning properly. Server logs are retained for a limited time (typically 15-30 days) and then automatically purged.
  • User-Submitted Logs: If you voluntarily submit a support request using the in-app report form, you will be notified that application logs will be sent along with your message. These logs may include device information, app state, and diagnostic data to help us troubleshoot your specific issue. This data is only sent when you explicitly choose to submit a report.
  • Device Identifier: When you first open the application, it generates a unique device identifier and stores it locally on your device. This identifier is also sent to our server and tracked in our database. The device identity is used to track the use of free credits and prevent abuse.
  • Customer Identifier: When you make your first purchase, the application generates a unique customer identifier amd stores it in the database. The customer identity is used to manage the subscription, track credits usage and prevent abuse.
  • Local Storage Technologies: The app uses local storage on your device to remember certain preferences and maintain functionality. These technologies are used only to ensure the Service works correctly. We do not track users across third-party apps or websites.

Use of Your Personal Data

The Company may use your personal data for the following purposes:

  • To Provide and Maintain our Service: We use collected data to allow you to use the Service's features, such as generating subtitles for your videos. For instance, your uploaded audio content is used to produce a transcription, and device/customer identifiers are used to manage your free credits and subscription access. We also monitor technical logs to ensure the Service is running securely and efficiently, and to fix issues when they arise.
  • To Process Transactions and Manage Subscriptions: If you purchase a subscription, we use anonymous customer identifiers and subscription data from RevenueCat to keep track of your subscription status and provide access to premium features. We use this data to manage your subscription and track credits usage.
  • To Provide Customer Support: Any information you provide in contacting us (such as via the in-app support form) will be used to address your questions, solve any issues you might be facing, and improve your experience. We may respond to your support inquiries via email using the address you provided. We might also keep a record of support communications to help resolve future problems or for internal training on customer service.
  • To Improve and Analyze the Service: We use feedback and technical data to understand how to improve the Service. For example, we may analyze usage patterns to optimize the user interface and functionality. We may also perform data analysis to ensure our infrastructure can handle usage loads.
  • For Security and Fraud Prevention: We might use personal data (such as device identifiers or usage patterns) to monitor for suspicious or fraudulent activity and to maintain the security of our Service, users, and systems. This includes using certain data to prevent abuse of our transcription service and free tier credits.
  • For Compliance with Legal Obligations: In some cases we may need to process personal data to comply with laws and regulations. For example, we may retain transaction records for tax and accounting purposes, or use data to respond to lawful requests by public authorities.
  • For Business Transfers or Corporate Transactions: If we are evaluating or engaged in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, your personal data may be reviewed or transferred as part of that process (see "Business Transactions" below). We will ensure appropriate confidentiality protections in such events.
  • With Your Consent: If we ever process your personal information for a purpose that is not covered by the above, it will be done only if you have given us consent to that specific use. For example, if in the future we want to use a quote from your feedback publicly, we would ask for your consent.

Sharing Your Personal Data

We may share your personal information with the following categories of recipients, for the purposes described:

  • Service Providers: We employ third-party companies and individuals to facilitate our Service and perform functions on our behalf. These Service Providers only receive the personal data necessary to perform their tasks, and they are contractually obligated to protect it and use it solely for the purposes we specify. Our key Service Providers include:
    • Payment Processors: Apple App Store processes all subscription payments for the app. When you purchase through the App Store, your payment is handled entirely by Apple according to their terms and privacy policy. We do not receive your payment card details, billing information, name, or email from Apple. We do not handle or store your payment credentials on our servers.
    • Subscription Management: We use RevenueCat (based in the USA) to manage and verify subscriptions purchased through the Apple App Store. RevenueCat handles the technical aspects of in-app purchase management, including verifying purchase receipts from Apple, enabling purchase restoration across devices, and synchronizing subscription status. RevenueCat processes End User Technical Information (device type, operating system) and End User Transaction Information (last seen time, Apple receipt data) per their privacy policy. We do not send RevenueCat personal identifiers like your name or email address. RevenueCat's servers are located in the USA, and data processing is subject to their privacy policy and the safeguards described in the "Transfer of Your Personal Data" section of this policy.
    • Database Hosting: We use Supabase only for database hosting to store anonymous customer IDs, device identifiers, and subscription usage data (remaining credits per month for each customer). Supabase is a cloud service provider that hosts our database. They process data on our behalf to keep your data secure.
    • Email Delivery: We utilize Resend (resend.com) to send support messages. When you submit a support request, your email address and the content of our response are transmitted to Resend's systems for the purpose of dispatching the email to us. Resend acts as our processor for email communication.
    • Transcription Services (AI Providers): In order to convert your uploaded audio into text subtitles, we use third-party AI transcription service providers. Currently, we may send audio data to services such as Groq, OpenAI, or ElevenLabs (as needed, typically we use Groq as the primary provider with others as fallback). These providers receive the audio file to perform speech-to-text processing and return the transcript result to us. We do not provide them with information like your name, account, or email – only the audio content is sent for processing. However, note that the audio itself could contain personal information (for example, voices or spoken content). These providers process the data under their own terms (we ensure that they commit not to use the audio for anything other than providing the transcription service to us). We do not store the audio or the resulting text on our servers after we have relayed the transcript back to your Device.
    • Other Vendors: We may employ other service providers for various functionalities (for example, infrastructure hosting). We will update this Privacy Policy or maintain a list (upon request) if other significant processors are added. In all cases, we only share the data that is necessary for the provider to carry out their function, and we ensure they protect and handle the data in accordance with this Privacy Policy.
  • Business Transfers: If the Company is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, or asset sale, your Personal Data may be disclosed to prospective or actual purchasers or transferred to the new owner. We would provide notice to you before your personal data is transferred and becomes subject to a different privacy policy. Any new owner of the Service will be required to honor the commitments we have made in this Privacy Policy until it is updated and you are notified of changes.
  • Legal Obligations and Protection: We may disclose your personal data if such action is necessary to:
    • Comply with the law or respond to valid legal requests. For example, we might disclose data in response to a court order, subpoena, or a lawful request by government authorities (such as law enforcement).
    • Protect and defend the rights or property of the Company. This includes enforcing our agreements, terms of service, and investigating potential violations thereof.
    • Prevent or investigate possible wrongdoing in connection with the Service. For example, if we suspect fraudulent activity or misuse of our Service, we may share information with investigators or law enforcement.
    • Protect the personal safety of users of the Service or the public. If we believe someone is at risk of harm or there's an urgent threat, we might share data with the appropriate authorities.
    • Protect against legal liability. This covers sharing data with our legal advisors and insurers if necessary to handle a potential claim.
  • With Your Consent: Apart from the scenarios above, we will share your personal data with third parties only if you have given us consent to do so. For instance, if you consent to our sharing of a testimonial, or if you integrate WithSubtitles with another service and ask us to transfer your data, we will do so with your permission.

(We do not share or disclose personal data to third parties for their own marketing or advertising purposes, and we do not sell your personal information. See the section on California Privacy Rights for more details on "sale" of data in that legal context.)

Retention of Your Personal Data

The Company will retain your Personal Data only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Here's how this works in practice:

  • Anonymous Customer and Device Data: We retain anonymous customer IDs, device identifiers, and usage/credit data for as long as your subscription is active or until you request deletion. If you have an active paid subscription when you request deletion, we retain only the minimal data required to enforce subscription limits until the subscription period ends. Once your subscription expires, or if you have no active subscription when you request deletion, all personal data is permanently removed from our servers and from our processors. The only information that may remain temporarily are short-lived technical server logs, which are automatically deleted after a brief retention period (typically 15-30 days). We may retain minimal data for legal obligations such as basic transaction records for financial reporting, tax compliance, or auditing purposes.
  • User Content: As noted, we do not store your uploaded video/audio files or transcripts on our systems beyond the immediate needs of providing the Service. Any such content is processed transiently. Therefore, we do not retain this content once the processing is completed (aside from brief caching or backups that are automatically managed by our systems, which are typically short-lived). There could be server logs referencing the processing of content (e.g. a log entry that a transcription occurred at a certain time), but those logs do not contain the content itself and are only kept for debugging and monitoring purposes.
  • Communications: If you contacted us for support or feedback, we may retain those communications and our responses for a period of time to ensure we have context for any follow-up and to improve our support processes. We typically retain support emails for as long as necessary to address your issue and any related issues that might arise, and for a reasonable period thereafter.
  • Usage Data: Server logs and diagnostics are retained for a shorter period of time, mainly for operational monitoring, debugging, and security purposes. Typically, these logs are purged periodically (for example, logs might be retained for 15-30 days). If certain log data is needed to investigate security incidents or to fix critical bugs, we may retain that specific data longer. Additionally, if required by law or if we are legally obligated (for instance, due to a law enforcement request), we may retain specific data for a longer period.

In summary, we aim not to keep personal data in identifiable form for longer than necessary. Once the retention period expires or the data is no longer needed, we will either delete it or anonymize it (remove identifying details) so that it can no longer be associated with you.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices in Poland and in any other locations where the parties involved in the processing are located. Many of our Service Providers are based in other countries (for example, the United States). This means that your personal data may be transferred to — and maintained on — computers or servers located outside of your state, province, country, or other governmental jurisdiction, where data protection laws may differ from those in your jurisdiction.

If you are located in the European Economic Area (EEA) or another region with data transfer restrictions, please note: You are sending your personal information to Poland and to other jurisdictions as necessary for the purposes described in this policy. In particular, some of our service providers (such as our email service, transcription providers, and payment processor) are based outside the EEA (e.g., in the United States).

By providing your information and using our Service, you agree to this transfer, storing, and processing of your personal data in these locations. However, we will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and applicable law. These steps include:

  • Adequate Safeguards: When we transfer personal data out of the EEA or other regions, we rely on appropriate safeguards, such as standard contractual clauses approved by the European Commission, or transferring data to jurisdictions that have been deemed to have an adequate level of data protection by relevant authorities. We also ensure that service providers who process data outside your jurisdiction have committed to protecting personal data to standards that meet the requirements of your home jurisdiction's law (for example, through contractual obligations).
  • Security Measures: Regardless of where your data is processed, we apply the same security measures (described in the "Security of Your Personal Data" section) to protect it. We also contractually require service providers to handle data securely and confidentially.

No transfer of your Personal Data will take place to an organization or a country unless we are satisfied that there are adequate controls and protections in place for your data, including the security of your data and other personal information.

Delete Your Personal Data

You have the right to request deletion of the personal data that we have collected about you, and you may exercise this right through the Service or by contacting us directly.

  • In-Service Deletion: The Service provides the ability to delete your data directly from within the app settings. When you use this deletion feature, we will delete your anonymous customer ID, device identifier, and credit tracking data from our databases.
  • By Request: You can also request that we delete any personal information we have about you by contacting us at our support email (provided in the Contact Us section). Upon receiving a verified deletion request, we will delete your personal data from our active databases and instruct any of our service providers (data processors) holding your Personal Data to do the same, to the extent required.

Deletion Timeline:

  • Deletion may take up to 7 days after your request to be fully processed across all systems.
  • If you have an active paid subscription when you request deletion, we will retain only the minimal data required to enforce your subscription limits until the subscription period ends. This ensures we can fulfill our contractual obligations to you.
  • Once your subscription expires, or if you have no active subscription when you request deletion, all personal data is permanently removed from our servers and from our processors.
  • The only information that may remain temporarily are short-lived technical server logs, which are automatically deleted after a brief retention period (typically 15-30 days).

Important: Once you delete your data, you will permanently and irrevocably lose access to any remaining free credits. This deletion process is irreversible and you cannot restore your free credits after deletion.

Please note that there may be limited exceptions where we retain certain data:

  • We might retain minimal data for legal obligations – for instance, basic transaction records may need to be kept for financial reporting, tax compliance, or auditing purposes.
  • We may keep data as necessary to protect our rights or comply with law – for example, information might be retained if needed to resolve disputes, enforce our terms, or prevent fraud or abuse.
  • In backups or archives: It's possible that your data could reside for a time in our archived data (e.g., routine backups). If so, we will securely isolate it from any active use and will delete it as those backups are cycled out.

Rest assured, aside from the exceptions above, we will make a good faith effort to honor your request and delete your data from our systems. If we must retain anything for the reasons stated, we will only do so for the required period and your data will not be used for any other purpose during that retention.

Security of Your Personal Data

We value your trust in providing us your personal information, and we strive to use commercially acceptable means to protect it. We implement a variety of security measures to maintain the safety of your Personal Data. These measures include, for example, using encrypted connections (HTTPS) for data transfer between your Device and our servers, securing databases with authentication and access controls, and using reputable third-party processors that adhere to high security standards.

However, please remember that no method of transmission over the internet or method of electronic storage is 100% secure. While we and our service providers take reasonable efforts to protect your Personal Data, we cannot guarantee its absolute security. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of information at any time. You should also take care with how you handle and disclose your Personal Data and avoid sending sensitive information via insecure means.

If we become aware of a data breach that affects your Personal Data, we will notify you and the relevant authorities as required by law.

Children's Privacy

Our Service is not intended for anyone under the age of 13, and we do not knowingly collect personally identifiable information from children under 13 years of age. If you are under 13, please do not use the Service or provide any personal information to us.

In the event we learn that we have inadvertently collected Personal Data from a child under 13 without verified parental consent, we will take steps to delete that information from our servers as soon as possible. If you are a parent or guardian and you discover that your child under 13 has provided us with Personal Data, please contact us so that we can take the necessary actions.

For residents in the European Economic Area or other regions with stricter age requirements: If we need to rely on consent as a legal basis for processing your information and your country requires consent from a parent for minors (for example, under 16 in some EU countries), we may require a parent's consent before we collect and use that information. We will follow the laws applicable to the age of digital consent in the country where you are located.

Our app may contain links to other websites or services that are not operated by us. For example, the app might include links to a help center, documentation, or payment pages hosted by our payment processor. If you tap on a third-party link, you will be directed to that third party's site or service (which may open in Safari or an in-app browser).

We strongly advise you to review the Privacy Policy of every external site or service you interact with. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. If you leave our app to visit a third-party site, be aware that this Privacy Policy no longer applies; instead, the privacy policy of that third party will govern the handling of your data.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. When we make changes, we will post the updated policy on this page and update the "Last updated" date at the top. If the changes are significant, we will also notify you by means of a notice within the Service prior to the change becoming effective, and we'll outline the key differences in the update.

You are advised to review this Privacy Policy periodically for any changes. Policy changes are effective immediately once they are posted on this page, unless stated otherwise. Your continued use of the Service after the effective date of any changes will constitute your acceptance of the modified terms.

GDPR Data Protection Rights

If you are located in the European Economic Area (EEA) or other regions with similar data protection laws, you are entitled to certain rights under the General Data Protection Regulation (GDPR) and related laws. We are committed to making it easy for you to exercise these rights:

  • Legal Basis for Processing: We only collect and process your Personal Data when we have a legal basis to do so under GDPR. This means we rely on one of the following grounds:
    • Performance of a Contract: We process data to provide you with the Service you requested — for example, managing your subscription and providing access to premium features. This is necessary for us to perform our agreement with you.
    • Legitimate Interests: We may process data for our legitimate business interests, such as improving and securing our Service, preventing fraud and abuse of the free tier, or analyzing usage patterns to optimize functionality (as long as those interests are not overridden by your privacy rights). For instance, tracking device identifiers to prevent abuse of free credits is in our legitimate interest to maintain a sustainable service.
    • Consent: In cases where we ask for consent, you have the choice to allow us to process your data for a specific purpose. For example, when you voluntarily submit a support request with your email address, or if in the future we ask for your consent to use a new feature, you can opt in or out. You have the right to withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
    • Legal Obligation: We will process personal data if it's necessary for us to comply with a legal obligation, such as retaining financial records for tax purposes or providing information if lawfully required by authorities.
  • Your Rights: Under GDPR, you have the following rights regarding your personal data:
    • Right of Access: You have the right to ask us for copies of your Personal Data that we hold, and information about how we process it. We will provide you with a copy of the data in a common format, free of charge (unless the request is repetitive or excessive, in which case a reasonable fee may apply). Note that due to the anonymous/pseudonymous nature of our data collection, we may need additional information from you to locate your data.
    • Right to Rectification: If any of your information is inaccurate or incomplete, you have the right to request that we correct or update it. Given the limited and pseudonymous nature of the data we collect, this right may be limited in practice. If you believe we have incorrect information (for example, in a support email exchange), let us know and we will fix it.
    • Right to Erasure (Right to be Forgotten): You have the right to request that we delete your Personal Data, under certain conditions. See "Delete Your Personal Data" above for more details on how to request deletion and the circumstances in which we can fulfill such requests.
    • Right to Restrict Processing: You can ask us to limit the processing of your data in certain situations. This might apply if you contest the accuracy of your data (until we verify or update it), or if you object to our processing based on legitimate interests, or if processing is unlawful and you prefer restriction over deletion.
    • Right to Object: You have the right to object to our processing of your Personal Data when we process it based on legitimate interests or for direct marketing. For example, you can object to us using your data for analytics or certain communications. If we receive a valid objection, we will cease the processing activity objected to, unless we have compelling legitimate grounds to continue (or if it's needed for legal reasons).
    • Right to Data Portability: You have the right to request that we provide your Personal Data to you, or directly to another controller, in a structured, commonly used, machine-readable format, when the processing is based on your consent or on a contract and carried out by automated means. In simpler terms, you can ask for an electronic copy of the data you gave us, so you can move it to another service.
    • Right not to be subject to Automated Decision-Making: We do not use personal data for any automated decision-making or profiling that produces legal or similarly significant effects on you. If that ever changes, you would have the right to not be subject to a decision based solely on automated processing (including profiling) without human intervention.
  • Exercising Your Rights: You can exercise any of these rights by contacting us (see Contact Us below). We may ask you to verify your identity before responding to such requests (this is to ensure that your data is protected and we're not giving it out to the wrong person). Given the anonymous nature of our accounts, verification may require you to provide information such as device details, transaction information, or other data that helps us locate your records. We will respond to your request within one month, or inform you if we need more time. There is no fee for making a request, although excessive or unfounded requests can be refused or may incur a fee as allowed by law.
  • Complaints: If you believe that our processing of your Personal Data infringes your rights or GDPR, you have the right to lodge a complaint with a supervisory authority (data protection authority) in the EU. In Poland, our home country, the supervisory authority is the President of the Personal Data Protection Office (UODO). If you reside in another EEA country, you can contact your local data protection authority. Of course, we would appreciate the chance to address your concerns directly first, so we encourage you to contact us with any questions or issues regarding your personal data.

California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

Information We Collect: In the past 12 months, we have collected the following categories of personal information as described in this Privacy Policy: identifiers (device identifiers, anonymous customer IDs), customer records (email address when voluntarily provided via support form), commercial information (subscription details from Apple/RevenueCat including device type, operating system, transaction data), internet activity (server logs for API requests containing technical information), and audio content (processed transiently for transcription only, not stored).
