Terms of Use for WithSubtitles iOS app

Welcome to WithSubtitles, an app developed and owned by Artur Rosa (a sole proprietorship based in Poland). These Terms of Use (“Terms”) govern your access to and use of the WithSubtitles iOS app. By downloading, installing, or using the app, you agree to comply with these Terms. If you do not agree, please do not use the app. We may update these Terms from time to time; continued use after changes will constitute acceptance of the revised Terms.
WithSubtitles is a mobile app designed to help you create stunning, dynamic subtitles for short-form videos. You can import your videos and automatically generate beautiful, animated captions that keep your viewers engaged. The app interface is in English, but it can generate subtitles in multiple languages.
The app does not include any user-to-user communication, social networking, or content-sharing features. It is intended for creating and editing subtitled videos. All your content remains accessible only to you on your device, and we do not store your videos or subtitles beyond what is needed for immediate processing.
Automatic subtitle generation in WithSubtitles is limited by usage quota measured in minutes. When you create a project from a video, the app extracts the audio and process it through AI transcription services to generate captions. The length of that audio counts toward your quota.
WithSubtitles offers a limited free tier that requires no subscription or account registration: each device receives a one-time quota of minutes of audio processed. This free quota is device-specific, non-renewable, and cannot be transferred. You may use these free minutes without creating an account or starting a subscription.
You may purchase a subscription at any time, even before exhausting your free minutes. If your subscription expires or is canceled, any remaining free minutes will still be available to you.
Paid subscriptions are currently available through Apple's In-App Purchase (IAP) system. We may offer additional payment methods in the future (such as web-based purchases through our website). We offer a single Premium subscription tier with two billing options: Monthly and Yearly auto-renewing plans. Both billing options provide the same features and monthly quota of minutes. Your monthly quota is calculated per calendar month (from the 1st to the last day of each month), regardless of your billing cycle. Unused minutes do not roll over to the next month. Each subscription automatically renews at the end of its billing cycle unless you cancel beforehand. Subscription prices are subject to change, and you will be notified of any price changes before they take effect. If a subscription payment fails, Apple will attempt to collect payment and may suspend your access until the payment issue is resolved. You can manage or cancel your subscription through the payment method you used to purchase (for IAP subscriptions, this is done through your Apple Account Settings). Cancellation takes effect at the end of the current billing period; you retain access to premium features until then.
Subscriptions are personal and non-transferable. IAP subscriptions cannot be shared via Apple Family Sharing. However, you may use your subscription on multiple devices logged into the Apple ID; your monthly quota is shared across all your devices. Note that only your subscription quota syncs across devices — we do not store your projects, videos, or subtitles in the cloud. All your content remains local to each device.
For subscriptions purchased through Apple's IAP, Apple (not us) handles all payments, billing, and refunds. All charges occur through your Apple ID and are subject to Apple's policies. All billing and transaction processes are handled by the App Store and are governed by Apple's terms and conditions. For refund requests on IAP purchases, please contact Apple directly. If we introduce alternative payment methods in the future, those transactions will be handled by the respective payment processor (details will be provided at the time of purchase). We do not accept cash or cryptocurrency, and no other purchases (such as in-app coins or gifts) are available in the app beyond subscriptions.
WithSubtitles does not require account creation. Subscriptions are managed using anonymous transaction identifiers.
You may delete your account at any time. If you have an active subscription, we will retain only the minimal data required to enforce your subscription limits until the subscription period ends. Once your subscription expires, or if you have no active subscription, all personal data is permanently removed from our servers and from our processors. The only information that may remain temporarily are short-lived technical server logs, which are automatically deleted after a brief retention period. All project data (videos, transcripts, styles, etc.) is stored locally on your device only; removing the app from your device deletes this content.
We collect and process personal data necessary to provide the subtitle generation service. When you create a project from a video, the audio track is extracted and sent to third-party AI services (such as Groq, ElevenLabs, or OpenAI) for subtitle generation. By using the app, you consent to having your audio data sent to these AI providers for this purpose.

WithSubtitles is designed for international use but may not be available in certain countries due to compliance with regional privacy regulations, export controls, or technical limitations. Apple's App Store distribution system enforces regional availability. If the app is not available in your country's App Store, you may not use the service. You must comply with all applicable local laws when using WithSubtitles.
The WithSubtitles app, including all software, code, design, interface, logos, and trademarks, is owned by Artur Rosa and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the app.
However, any content you create or upload — including your videos, audio files, subtitles, and exported videos with subtitles — remains your property. We claim no ownership rights over your content.
Subtitles generated by WithSubtitles are automated and may contain errors. Because subtitle generation relies on third-party AI speech recognition services, we cannot guarantee 100% accuracy or the quality of results. All subtitles are provided "as is" and you use them at your sole risk. We make no warranty on subtitle quality or completeness.
WARRANTY DISCLAIMER: The WithSubtitles service is provided "as is" and "as available", without any warranties of any kind. We explicitly disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the app will be error-free, uninterrupted, or free of harmful code. In particular, speech recognition is an automated process and may produce inaccurate or incomplete subtitles. You acknowledge that automated subtitle generation is inherently fallible; we make no promises about the accuracy, completeness, or usefulness of any subtitles you obtain.
LIMITATION OF LIABILITY: To the maximum extent permitted by law, Artur Rosa (the developer) and its affiliates will not be liable for any damages arising from your use of the app or inability to use it. This includes, without limitation, any direct, indirect, special, incidental, punitive, or consequential damages such as loss of data, loss of profits, personal injury, or property damage. We are not responsible for any damages caused by errors in subtitle generation, interruptions in service, or actions of third-party providers (such as Groq, ElevenLabs, or OpenAI). In other words, you use this app at your own risk and assume all responsibility for any data or business decisions based on the subtitled videos. No part of this disclaimer shall limit liability that cannot be excluded under applicable law.
We reserve the right to suspend or terminate your access to the app and your account at any time, for any reason (e.g. violation of these Terms or cessation of service). Upon termination, your right to use the app will end. You may cancel your subscription at any time via your Apple account; cancellation takes effect at the end of the current billing period. Similarly, you may delete your account as described above, which will end your right to use the service. If the app is removed from the App Store or no longer supported, we may cease providing services; by installing or using the app, you acknowledge that Apple or we could discontinue the app without notice and without liability.
We may modify these Terms at any time. When we do, we will post the updated Terms here with a new revision date. Any changes will apply to new and existing users. Your continued use of WithSubtitles after changes are posted means you accept the new Terms. We encourage you to review these Terms periodically. If you disagree with the changes, your sole remedy is to stop using the app.
These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the app shall be subject to the jurisdiction of the courts of Poland.
